Couple Want Out Of Landmarked District

For Kevin and Diana Mosley, their dream house has turned into a nightmare. They are fighting the city — and some of their neighbors — to opt out of the historic district that includes their Douglaston home.

The couple testified at a Landmarks Preservation Commission hearing on Tuesday in Manhattan to plead their case. “This is an unusual case because we got permission (from the Department of Buildings) to do the work before the area was landmarked,” Diana Mosley said.

The couple filed an Article 78 lawsuit against the landmarks commision to remove their house from the historic district, saying the designation was based on erroneous information. The Supreme Court agreed and ordered the house excluded from the district, but gave the commission the option to re-examine it.

Fifteen months after the Mosleys won their court case, the LPC did exactly that. “We thought it was over, but the local historical group pressured the commission,” Diana Mosley said.
