ALERT: BSA VOTES NO on 182 15th St., Bklyn vesting–Developer is not rewarded!

The BSA unanimously voted to deny the vesting application of developer Isaac Katan’s 182 15th St. proposed 11-story tower.

Developer’s attorney Howard Hornstein of Cozen O’Connor has 30 days to appeal the BSA’s decision to the State Supreme Court. (The higher courts have in the past supported BSA decisions.)

Our community has won its first BSA appeal case (three earlier properties were granted vestment). We are most encouraged that the BSA took seriously the community’s allegations of illegal and improper practices that took place on this site during demolition, excavation and foundation construction and requested the Dept. of Buildings to investigate the allegations and provide a final determination. The conclusion of the DOB’s July 13 response letter to the Board says it all and reiterates what our community has said time and again: “Global Development should not be rewarded for illegal construction undertaken in an effort to beat the zoning clock.”

We hope that the BSA will continue to uphold DOB rulings on illegal work and that the judgments on the remaining three appealing properties in our area (614 7th Ave., 1638 Eighth Ave., 422 Prospect Ave.) will be given the proper evaluation as well.

In addition, we will be drafting a duo “thank you letter/do the right thing on 614 7th Ave” letter with thanks to the BSA on 182 15th St., but also encouraging them to again uphold DOB’s assertion that the original plans for 614 7th Ave were NEVER LEGAL and thus no work can be credited until after Nov. 15, 2005 (approx. 99% of the foundation and excavation must be eliminated). Form letter out to the groups and our elected officials for mailing to the BSA in the next day or so, thank you in advance!
