ALERT: South Slope BSA Letter Regaridng 15th Street Tower & Minerva Building

As promised, here is the form letter to send to the BSA to THANK THEM for NOT VESTING 182 15th St. first and foremost.

Secondly, as reported by articles in the press/media (and SHOUTED ON HIGH, by yours truly) to REMIND THEM that 614 7th Ave is in a similar case where they should not reward a developer for illegal behavior, in this case from his architect. Any the other two cases, 422 Prospect and 1638 8th Ave, for that matter…

DOB has submitted testimony ( on 2 occasions) that if a proper audit had been done on the plans for 614 7th Ave, instead of the self certified filing by Robert Scarano, they WOULD HAVE NEVER ISSUED WORK PERMITS, thus ANY work done between August 31, 2005 and the reinstatement of the AUDITED plans, then approved on November 15th, 2005 (one day before the rezoning) must be discounted under illegal and invalid permits.

That’s 99% of the work folks.

PLEASE TAKE 5 MINS AND CUSTOMIZE AND SEND OUT THIS LETTER TO THE BSA.

We are encouraging ALL OF YOU and our ELECTED OFFICIALS to please send this letter off next week. In addition, please put Tuesday, August 15, 2006 in your calenders at the BSA for the final decision for 614 7th Ave., one we are hopeful will be the same and as dramatic as 182 15th St. which has paved the way for this decision and other in the future.

Dear Chair Srinivasan,

I would like to thank you and the Board for voting to not vest 182 15th Street, Brooklyn, under our old zoning. Thank you for the opportunity that you gave our community to speak out against the vesting of this property and for taking the time to consider our testimony and evidence as well as that of the applicant.

Your ruling sends a strong statement to developers in our community and other communities in Brooklyn that the Board will not tolerate illegal activity and will take such activity into full consideration when reviewing any vesting application.

I hope the Board will also vote no on the vesting of 614 7th Avenue, Brooklyn. While I understand that each case is judged according to its particular circumstances, I feel the DOB’s determination of illegal behavior in both these cases suggest that the Board review the appeals with similar criteria.

DOB has determined that the only work to be counted towards vesting of 614 7th Ave. is that which was done under the permit reinstated on November 15, 2005. In my and our community’s opinion, this seems a clear statement that there is no legal foundation to speak of and so the property cannot be vested.

Thank you again for the generous time and consideration given to the community at the hearings of 182 15th Street, as well as at the hearings 614 7th Avenue and the five other properties in our neighborhood that have come before the Board in appeals stemming from our recent rezoning.
