Manhattan: Settlement in Landmarks Suit

The owners of Sushi Samba, a restaurant at 87 Seventh Avenue in the Greenwich Village Historic District, have agreed to pay $500,000 and build a new rooftop in a settlement with the New York City Landmarks Preservation Commission, the city announced yesterday. In 2000, the commission gave the restaurant permission to build a wooden open-air trellis on its roof. The restaurant built the trellis, but added several steel arches and covered the structure with a canvas-and-plastic enclosure, making it a year-round second story. The commission refused to approve the structure, and a Civil Court judge upheld the decision in 2003. The same year, the commission sued Sushi Samba after the restaurant refused to remove the addition. In June, a judge ruled in favor of the city and directed a referee to set civil damages.
